Terms of Service

Effective Date: 15-Oct-2026  |  Last Updated: 15-Oct-2026

1. Introduction

These Terms of Service (“Terms”) govern access to and use of EK-HRM, a Human Resource Management System that provides tools for employee management, attendance, leave, payroll, and other HR-related activities.

“EK-HRM”, “we”, “our”, and “us” refer to the entity operating the Platform. “Organisation” refers to a company or other entity using EK-HRM to manage its workforce. “User” refers to an employee, administrator, or other authorised individual using the Platform.

By accessing or using EK-HRM, you agree to comply with these Terms and any applicable organisational policies. If you do not agree to these Terms, you should not use the Platform.

2. Eligibility and Accounts

Organisations may create or administer accounts for authorised personnel in accordance with the applicable subscription or service agreement. Users must provide accurate information where required and maintain the confidentiality of their login credentials.

Users should promptly report suspected unauthorised access or account compromise. Organisations are responsible for managing user access and updating permissions when an individual's role or employment status changes.

3. Services Provided

Depending on the subscription, configuration, and features enabled, EK-HRM may provide employee and organisational management; attendance and working-hour tracking; location-based attendance verification; live face verification; device registration; leave management; payroll and salary administration; employee records and document management; HR reports and dashboards; notifications; and related HR tools. Not every feature is necessarily available to every organisation.

4. Acceptable Use

Users agree not to:

5. Attendance and Verification

EK-HRM may provide tools for recording check-in, check-out, attendance status, and related information. Where enabled, attendance verification may depend on location permissions, configured office locations, registered devices, and live face verification.

Users are responsible for following their organisation's attendance procedures. Attendance records may contain errors because of technical issues, device limitations, network failures, or incorrect configuration. Organisations should establish a process for reviewing and correcting attendance records.

EK-HRM provides attendance-management tools. Employment-related decisions remain the responsibility of the relevant organisation, subject to applicable law.

6. Device Registration

Organisations may configure device-registration restrictions, including limiting attendance access to a registered device. Where approval is required to change devices, users must follow the applicable process. The Platform may record device-related information needed to enforce configured restrictions and maintain account security.

7. Leave and Payroll

Where leave management is enabled, users may submit leave requests and authorised personnel may review them according to organisational rules. Where payroll features are enabled, the Platform may assist organisations with salary-related records and calculations.

Organisations remain responsible for configuring appropriate payroll rules, reviewing calculations, maintaining accurate employee information, and meeting applicable legal obligations. Users should report discrepancies through their organisation's designated HR or payroll process.

8. Organisational Responsibilities

Each organisation using EK-HRM is responsible for providing accurate employee information; assigning appropriate user roles and permissions; configuring attendance, leave, and payroll rules; establishing employee policies; reviewing attendance and payroll records; managing access when roles change or employment ends; providing required notices and obtaining required permissions or consents; handling employment decisions and grievances appropriately; and complying with applicable employment, privacy, and recordkeeping requirements.

9. Privacy and Data Protection

Use of EK-HRM is also governed by the applicable Privacy Policy. Organisations and users should review that policy to understand how personal information is processed.

The responsibilities of EK-HRM and each organisation depend on the services provided, the parties' actual roles, and applicable law. Any additional data-processing agreement or service agreement will also govern the relevant relationship.

10. Service Availability and Maintenance

We aim to maintain a reliable service but do not guarantee that EK-HRM will always be available without interruption. The Platform may occasionally experience downtime due to maintenance, technical problems, network failures, hosting-provider issues, or circumstances beyond our reasonable control. We will take reasonable steps to address service disruptions.

11. Intellectual Property

The Platform, including its software, design, branding, documentation, and associated materials, is owned by or licensed to the relevant rights holder. Users and organisations may use the Platform only as authorised by these Terms and any applicable agreement. These Terms do not transfer ownership of the Platform's intellectual property.

12. Suspension and Termination

Access may be suspended or terminated where reasonably necessary because of a material violation of these Terms, suspected fraud or unauthorised access, security risks or misuse, non-payment under an applicable subscription agreement, a legal requirement, or termination of the relevant organisational subscription or agreement.

Where appropriate and legally permitted, we will provide notice and an opportunity to address the issue. Data export, retention, and deletion arrangements should be governed by the applicable service agreement and Privacy Policy.

13. Disclaimers

EK-HRM provides software tools to support HR administration. Except as expressly stated in an applicable agreement or required by law, the Platform does not independently guarantee the accuracy of information entered by users or organisations. Organisations are responsible for reviewing relevant records and ensuring that their HR policies, attendance rules, and payroll configurations are appropriate.

Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded.

14. Limitation of Liability

To the extent permitted by applicable law, liability arising from the use of EK-HRM will be governed by these Terms and any applicable service agreement. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. Any additional limitations should be reviewed by a qualified legal professional.

15. Changes to These Terms

We may revise these Terms to reflect changes in our services, business practices, or legal obligations. The updated Terms will include a revised date. Where required, we will notify affected users or organisations and obtain any necessary agreement before the changes take effect.

16. Governing Law and Disputes

These Terms are subject to the laws of India, to the extent applicable. Disputes will be handled in accordance with applicable law and any valid dispute-resolution provisions in the relevant organisational agreement. Any specific jurisdiction or arbitration clause should be finalised with qualified legal advice before publication.
